Iron Swords Postponements: Your Guide

A new law was published October 19, 2023. It addresses Iron Swords Postponements.

This law specifies who can postpone payments. Eligible individuals get a 30-day postponement. Public input remains open. The situation is dynamic; more changes are expected.

Eligibility

The law outlines 11 categories of individuals eligible for postponements. This applies during the “relevant period,” currently October 7 to November 7, 2023.

Eligible Categories

Those eligible for Postponements Due to Iron Swords War include:

• Soldiers: Regular or reserve soldiers who served.
• Police Officers: Those who served as police.
• Prison Guards: Specific units or wings.
• Firefighters: Individuals who served as firefighters.
• Missing/Captive Individuals: Those who were missing, kidnapped, or captive.
• Affected Residents: People living in specific municipalities until October 7, 2023.
• Injured Individuals: Hospitalized at least 7 days due to enemy attack.
• Rescue Personnel: Full-time employees/volunteers of listed rescue organizations.
• Spouses: Spouses jointly liable for obligations (of categories 1-8).
• Estates: Estates of deceased persons (from categories 1-5, 7, 8).
• Companies/Partnerships: Small companies or partnerships with a qualifying shareholder/manager.

List of Eligible Municipalities

Currently, 99 municipalities are listed. This list might change based on the conflict.

The municipalities include: Nahal Oz, Erez, Nir Am, Mefalsim, Kfar Aza, Gavim, Or Haner, Netiv Ha’asara, Zikim, Yad Mordechai, Karmiya, Kerem Shalom, Kisufim, Hulit, Sufa, Nirim, Nir Oz, Ein Hashlosha, Nir Yitzhak, Bari, Magen, Re’im, Saad, Alumim, Sderot, Be’erot Hilel, Dorot, Yachini, Ivim, Gav’am, Mevo’ot Betar, Yated, Shlomit, Neve, Sha’ar Avraham, Mevo’ot Betar, Yesha, Ami’oz, Peri Gan, Telmei Yosef, Ein Hashlosha, Yavul, Avshalom, Dekel, Tsor’ah, Ohad, Telmei Eliyahu, Sha’ar Nitzan, Be’er Nitzan, Shokeda, Shova, Kfar Mimoun, Tushiya, Zemeret, Misgav Am, Manara, Malkia, Ma’aleh Baruch, Yiftah, Dafna, Margaliot, Kfar Yuval, Kfar Rosh HaNikra, Hanita, Zara’it, Shitula, Avivim, Metula, Shlomi, Shomera, B’tse’t, Ya’ara, Dishon, Adמית, Arab al-‘Aramsha, Re’ger, Dovyev, Matat, Bar’am, Yiron, Nitu’a, Kfar Gil’adi, Ashkelon, Kiryat Shmona, Snir, Dan, Beit Hillel, Sha’ar Yishuv, Hagoshrim, Liman, Tzuba, Elon, Hagoren, Gorenot HaGalil, Even Menachem, Sasa, Tzefon, Ramot Naftali.

Postponement Period

The law sets a 30-day postponement period. This applies to all eligible matters.

Iron Swords Postponements: Contract Deadlines

Contractual deadlines can be postponed by 30 days. This applies if specific conditions are met (Section 2(a), Postponement Law).

Conditions for Postponement

For Iron Swords Postponements, these conditions apply:

• It’s not an employment contract.
• The contract was signed before Oct 7 – Nov 7, 2023.
• Payment is due within that relevant period.
• The applicant qualifies for postponement.
• The applicant or representative notified other parties.
• Other parties are not eligible for postponement.

“Contract” includes checks and debt instruments. Thus, a check’s due date can be postponed.

Excluded Contracts

Not all contracts qualify for Iron Swords Postponements. These are excluded:

• Employment contracts.
• Credit transactions where goods/services were fully provided.
• Alimony payments (for spouse or children).

For example, an employer cannot postpone an employee’s salary. A refrigerator payment cannot be postponed if delivered before Oct 7, 2023.

Iron Swords Postponements: Court Orders

Payment deadlines from court orders can be postponed. This is possible if certain conditions are met (Section 3, Postponement Law).

Conditions for Court Order Postponements

These conditions apply to court order Iron Swords Postponements:

• The order came from a court or judicial entity.
• The court order is final (no appeals).
• The payment deadline falls within the relevant period.
• The payer is eligible for postponement.
• The order doesn’t concern alimony.

If all conditions are met, the deadline automatically shifts by 30 days. Notifying the other party isn’t required, but it is allowed.

Judicial authorities include: Execution Office Registrar, Land Registrar, religious court judges, and disciplinary court judges.

Payments owed to authorities can also be postponed.

Conditions for Authority Payment Postponements

For these Iron Swords Postponements:

• The payment is mandated by law (e.g., property tax, fees, fines).
• The payer was hospitalized for 7+ days due to enemy attack.
• The payer works or volunteers full-time for a listed rescue group.
• The payer notified the authority of meeting conditions.
• The payer didn’t use online paid services during the period.

If all conditions are met, the payment deadline shifts by 30 days.
