By law, a small claim statement must be initiated using a small claim form prepared by the judiciary. This is a completely free form available for download online; the only cost involved is the statutory filing fee.
The form is available in PDF format (i.e., non-editable). The claimant must print the form, fill it out by hand, and attach documents. Besides being outdated (and producing a less aesthetically pleasing result), the form’s fields are generic and often insufficient for adequately describing the case. For example:
In the “Description of the Claim” section, the claimant is first asked to describe the place and date on which “the obligation for payment of the claimed sum arose, whether by agreement between the parties or otherwise”.
Needless to say, this field is irrelevant for most small claims. What do you write in this field when dealing with a spam claim? Or an aviation claim? Or a claim for a traffic accident?
The point is clear. Most fields in the form present similar difficulties in accommodating case-specific details. Consequently, claimants may struggle to describe their simple case accurately, failing to adequately reflect their claims.
Furthermore, the submission of printed, handwritten forms is undeniably outdated. It is clearly preferable to prepare a structured printed document using a computer or mobile phone.
Solicitors for Small Claims: An Option, But Not Always Best
Using a solicitor for small claims is an option. However, many small claims are simple, involving small sums. This makes hiring a solicitor less cost-effective and often unnecessary. Claimants often understand their case well and can describe it easily.
We want to be clear: if your case is complex or the claim amount is high, consulting a specialized solicitor is wise. But, while this is reasonable, it’s often expensive compared to the average small claim value.
There’s no guarantee you’ll recover solicitor fees as “legal costs.” Because of this, many claimants forgo legal help due to cost. Lacking alternatives, they give up their rights. Remember, by law, solicitor representation in small claims is usually prohibited. Special permission is rarely granted (about 1% of cases, for unusual situations).

Some websites offer two main options to tagish li:
- Online Court Form Preparation: This option doesn’t fix the basic flaws of the standard court form.
